    People's governments of provinces, autonomous regions and municipalities directly under the Central Government, ministries and commissions of the State Council and directly affiliated institutions:

    In order to further implement the scientific concept of development, accelerate the transformation of the mode of economic development, promote industrial restructuring and optimization and upgrading, and promote energy conservation and emission reduction, the following notifications are given to further strengthen the elimination of backward capacity:

    I. Deeply Understanding the Important Significance of Eliminating Backward Production Capacity

    Speeding up the elimination of backward production capacity is an important measure to change the mode of economic development, adjust economic structure, improve the quality and efficiency of economic growth. It is also an urgent need to speed up energy saving and emission reduction, and actively respond to global climate change. It is also an inevitable requirement to take a new road of industrialization with Chinese characteristics and to realize a strong industry. In recent years, with accelerating structural adjustment of industries with excess capacity, restraining duplicate construction and promoting the implementation of energy saving and emission reduction policies and measures, the elimination of backward capacity has achieved remarkable results in some areas. However, due to the prominent structural contradictions accumulated over a long period of time, imperfect policies and measures for the withdrawal of backward production capacity, insufficient incentives and constraints, deviations in understanding and inadequate implementation of responsibilities for eliminating backward production capacity in some areas, the current problem of the proportion of backward production capacity in some industries in China is still serious and has become a response to the improvement of the overall level of industry and implementation. Climate change initiatives, energy conservation and emission reduction tasks, and sustainable economic and social development are serious constraints. We must give full play to the role of the market, adopt more powerful measures, make comprehensive use of legal, economic, technological and necessary administrative means, further establish and improve a long-term mechanism for eliminating backward production capacity, and ensure that the objectives of eliminating backward production capacity are achieved on time. All regions and departments should take the elimination of backward production capacity as an important task in implementing the scientific concept of development in an all-round way, coping with the impact of the international financial crisis and maintaining stable and rapid economic development, further enhance the sense of responsibility and urgency, fully mobilize all positive factors, seize key links, break through key and difficult points, accelerate the elimination of backward production capacity, and vigorously promote industrial restructuring. Integration, optimization and upgrading.

    II. Overall Requirements and Tasks

    (1) General requirements.

    1. Play a market role. Give full play to the basic role of market in allocating resources, adjust and straighten out the price formation mechanism of resource-based products, strengthen tax leverage regulation, and strive to create a market environment conducive to the withdrawal of backward production capacity.

    2. Adhere to administration according to law. Give full play to the binding role of laws and regulations and the threshold role of technical standards, strictly implement laws and regulations and technical standards in environmental protection, energy conservation, clean production, safety in production, product quality and occupational health, and eliminate backward production capacity according to law.

    3. Target responsibility. The objective and task of eliminating backward production capacity should be resolved, the responsibilities of relevant departments of the State Council, local people's governments at all levels and enterprises should be clearly defined, and guidance, supervision and inspection should be strengthened to ensure that the work is carried out effectively.

    4. Optimizing the policy environment. We should strengthen policy constraints and incentives, coordinate the elimination of the relationship between backward capacity and industrial upgrading, economic development and social stability, and establish and improve a policy system to promote the withdrawal of backward capacity.

    5. Strengthen coordination and cooperation. The relevant departments should take the lead, cooperate closely with each other and take joint action to strengthen organizational leadership and coordination, so as to form joint efforts.

    (2) Target tasks.

    Focusing on electric power, coal, steel, cement, non-ferrous metals, coke, paper-making, leather-making, printing and dyeing industries, in accordance with the Decision of the State Council on Promoting the Implementation of the Provisional Regulations for the Adjustment of Industrial Structure (Guofa [2005], Circular of the State Council on the Issuance of the Comprehensive Work Programme for Energy Conservation and Emission Reduction (Guofa [2007]), and Wholesale and Transmit Development Reform of the State Council. Circular of the Party Committee and other departments on some opinions on restraining excess capacity in some industries and guiding the healthy development of industries through repeated construction (No. 38 of Guofa [2009]), Catalogue of Guidance for Industrial Structure Adjustment, and the scope and requirements for eliminating backward capacity stipulated in documents formulated by the State Council on industrial adjustment and revitalization plans for iron and steel, non-ferrous metals, light industry and textiles, etc., in order to eliminate backward capacity on schedule 。 According to the actual situation of local industrial development, each region can formulate a wider scope and higher standards to eliminate backward production capacity.

    The specific objectives and tasks of eliminating backward production capacity in key industries in the near future are:

    Electric power industry: more than 50 million kilowatts of small thermal power units will be phased out by the end of 2010. Coal industry: By the end of 2010, 8,000 small coal mines that do not meet the conditions for safe production, do not conform to industrial policies, waste resources and pollute the environment will be closed, and 200 million tons of production capacity will be eliminated.

    Coke industry: By the end of 2010, the small machine coke with a height of 4.3 meters or less in the carbonization chamber will be eliminated (except the tamping coke oven with a height of 3.2 meters or more).

    Ferroalloy industry: By the end of 2010, 6300 KVA submerged arc furnaces will be phased out.

    Calcium carbide industry: by the end of 2010, 6300 KVA submerged arc furnace will be phased out.

    Iron and Steel Industry: By the end of 2011, 400 cubic meters and less ironmaking blast furnaces, 30 tons and so on will be eliminated.
